Diminished Capacity Rape

This type of rape is committed when the person is forced to have sexual penetration and cannot give consent. Due to their inability to discern right or wrong, people with limited capacity cannot provide permission to another person. These people struggle to think and act because of physical or mental impairments. An example would be a person with an intellectual disability.
